Terms of Service

Effective May 9, 2026

These Terms of Service (“Terms”) govern your use of TappaTag products and services, including the website at tappatag.com, smart pet tags, and related services (collectively, the “Service”). By purchasing a tag, creating an account, or using the Service, you agree to these Terms.

Account Registration

To use TappaTag, you must create an account and provide accurate information including your name, email address, phone number, and pet details. You represent that (i) you are at least 18 years of age, or the age of majority in your state of residence, and (ii) you are a resident of the United States with a valid US shipping address and US-based phone number. You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to notify us promptly at hello@tappatag.com of any unauthorized access or suspected breach of your account.

Geographic Availability

TappaTag is offered solely in the United States and is intended for use by US residents. We sell and ship only to US addresses, and our call relay and SMS services are provisioned for US phone numbers. By purchasing a tag or creating an account, you represent that you are located in the United States. We make no representation that the Service is appropriate or available for use outside the United States, and we are not responsible for compliance with any non-US laws, including foreign data protection, telecommunications, or consumer protection laws. If you access the Service from outside the United States, you do so on your own initiative and at your own risk.

The Service

TappaTag provides smart NFC pet identification tags. When a finder taps your pet's tag with their smartphone, they see a contact page displaying your pet's name, photo, and a button to call you. The Service also includes:

  • Private call relay. Calls placed from the finder page are routed through a private relay so your real phone number is not revealed to the finder. You receive an SMS with a callback number after every finder call, whether answered or missed.
  • Optional pet care reminders. SMS reminders for flea & tick, heartworm, grooming, and vet visits, on a schedule you choose.
  • Walk logging and streak tracking. One-tap walk logging and shareable streak cards.
  • Additional features added over time.

The private call relay, care reminders, and other digital services are included with your TappaTag at no additional cost for the operational lifetime of the Service. There is no subscription, no annual renewal, and no separate fee for these services. All digital services are subject to the Availability of the Service and Usage Limits sections below.

Not an emergency service. TappaTag is a communication tool that connects finders with pet owners. It is not an emergency service, a veterinary service, a tracking or recovery service, or a substitute for emergency contact methods such as 911. Do not rely on TappaTag for emergencies involving people.

Third-party carrier dependency. The private call relay and SMS features rely on third-party telecommunications providers. Service may be temporarily or permanently unavailable due to carrier outages, number reassignment, regulatory changes (including A2P 10DLC requirements), provider pricing or policy changes, or other circumstances inside or outside TappaTag's control. TappaTag is not liable for missed calls or messages resulting from third-party service interruptions.

Availability of the Service

TappaTag operates the Service at its sole discretion and may modify, suspend, throttle, or discontinue any or all digital features at any time, with or without notice, including the private call relay, SMS alerts, care reminders, walk logging, and any other digital component of the Service. Reasons for modification, suspension, throttling, or discontinuation include but are not limited to: prevention of abuse, protection of service quality, infrastructure or carrier changes, regulatory requirements, business changes, and routine product evolution.

If TappaTag elects to permanently discontinue the private call relay, we will make reasonable efforts to provide at least 90 days' notice to active account holders by email. In the event of relay discontinuation, the finder page will continue to function and the “Call Owner” button will connect the finder directly to your phone number using a standard tel: link, which will reveal your number to the finder. Your physical tag will continue to work in this degraded mode for as long as the finder page remains operational.

No refunds, credits, or replacements will be issued in connection with any modification, suspension, throttling, or discontinuation of the Service.

Usage Limits & Abuse Prevention

The private call relay and SMS services are shared infrastructure provided to all TappaTag owners at no additional cost. We reserve broad discretion to throttle, limit, or remove these services from any tag or account where usage falls outside normal pet-recovery and pet-care patterns.

Call relay and SMS services are provided through third-party telecommunications infrastructure that carries per-call and per-message costs. Because these services are included free with every tag and shared across the entire TappaTag user base, we apply broad discretion to protect the system from fraud, automated abuse, and excessive use. You agree that:

  • Rate limits apply. TappaTag applies automated rate limits on the number of finder-initiated calls, SMS alerts, care reminder messages, and account-initiated actions per tag and per account over rolling time periods. Specific thresholds are maintained internally, may be adjusted at any time without notice, and are not published. Typical legitimate use falls well below applied limits. Calls or messages beyond applied limits may be blocked, delayed, throttled, or delivered to voicemail without prior notice.
  • Suspension or removal of digital services. TappaTag may temporarily or permanently throttle, suspend, or remove the private call relay, SMS alerts, care reminders, walk logging, or any other digital feature from any specific tag or account showing patterns inconsistent with ordinary pet-recovery and pet-care use. Examples include but are not limited to: automated tapping or scanning, repeated calls from the same finder number outside of a legitimate found-pet event, sustained call or SMS volume above ordinary patterns, evidence of resale or commercial redistribution of finder-page access, harassment or unwanted contact, fraudulent activity, suspected account compromise, and any use prohibited under the Acceptable Use section.
  • Degraded mode after relay removal. When the private call relay is removed from a tag, the tag continues to function. The finder page remains active and the “Call Owner” button connects the finder directly to your phone number using a standard tel: link, which will reveal your number to the finder.
  • Action without prior notice. TappaTag may apply rate limits, suspend services, or remove digital services from a tag without prior notice when reasonably necessary to protect the Service, other users, or third parties. Where practical, we will notify the affected account holder by email and offer a path to appeal.
  • No liability for applied limits. TappaTag is not liable for missed calls, undelivered messages, lost contact opportunities, or other consequences resulting from rate limits, throttling, suspensions, or removal of digital services applied in good faith.
  • No refunds for limits applied. Application of usage limits, throttling, or removal of digital services does not entitle the affected account holder to a refund of any portion of the original tag purchase price. Digital services are included with the tag at no additional cost; usage limits do not constitute a service shortfall.
  • Prohibited use. You agree not to use the call relay or SMS features for any purpose other than legitimate pet recovery and pet care, including but not limited to: automated tapping of tags, load testing, telemarketing, harassment, surveillance, or any commercial use outside the Service's intended purpose.

If you believe usage limits or service removal have been applied to your tag in error, contact us at hello@tappatag.com and we will review the case promptly. We reserve the right to make final determinations on a case-by-case basis.

One-Year Tag Warranty

Every TappaTag is backed by a one-year limited warranty. If your tag fails due to a manufacturing defect under normal use within one (1) year of the original purchase date, we will replace it one time, free of charge.

  • Coverage period: One (1) year from the original purchase date. Proof of purchase may be required.
  • One-time replacement: The warranty covers one (1) replacement per tag. Replacement tags carry the remainder of the original tag's one-year coverage and are not separately warrantied beyond it.
  • Original tag deactivated: Upon activation of your replacement, the original tag will be permanently deactivated and will no longer route to your pet's profile.
  • Not covered: Loss, theft, chewing or pet damage, intentional destruction, water damage beyond normal wear, modifications to the tag, the carabiner rubber grommet (replacement grommets are available separately at cost), or cosmetic wear that does not affect function.
  • Digital services separate. The warranty covers the physical tag only. The private call relay, SMS alerts, care reminders, walk logging, and any other software-based feature are governed by the Availability of the Service and Usage Limits sections above and are not covered by the one-year tag warranty.
  • Shipping: TappaTag covers outbound shipping for approved warranty replacements. The customer is responsible for return shipping of the original tag if requested.

To make a warranty claim, contact us at hello@tappatag.com with your tag ID, proof of purchase, and a description of the defect.

Veterinarian Information

You may optionally add your pet's veterinarian information, including the clinic name and phone number, to your pet's profile. This information is displayed on the finder page under “Medical & Vet Info” for emergency reference, allowing a finder to contact your pet's vet directly if needed.

By providing veterinarian contact information, you represent that the phone number you provide is the clinic's publicly listed business number and that you are responsible for keeping it accurate. TappaTag does not place automated, marketing, or care-reminder communications to veterinarian numbers. Calls placed to the veterinarian from the finder page are direct calls to the clinic's published business line and are not routed through TappaTag's private relay. TappaTag does not verify veterinarian information and is not responsible for calls placed to outdated, incorrect, or mistyped numbers.

You may add, change, or remove veterinarian information at any time from your dashboard.

Walk Logging & Streaks

Walk logging, streak tracking, and shareable streak cards are available to all TappaTag owners. You can log walks by tapping the tag with your phone. Streak data is stored in your account and persists across tags. Streak data is deleted when you close your account. Walk logging and streak features are subject to the Usage Limits & Abuse Prevention section above.

Refund Policy

We stand behind our product. Our refund policy is designed to be clear and fair:

  • 30-day satisfaction guarantee: Unactivated tags in original, unused condition may be returned within 30 days of purchase for a full refund of the tag price. Return shipping is the responsibility of the customer.
  • After activation: Once a tag is activated and protecting your pet, the sale is final and no refunds will be issued, except where required by applicable law.
  • Service discontinuation: No refunds, credits, or replacements will be issued in connection with any modification, suspension, throttling, or discontinuation of the Service.
  • Usage limits applied: No refunds will be issued in connection with rate limits, throttling, or removal of digital services applied to a tag or account under the Usage Limits & Abuse Prevention section above.

Mobile Messaging Terms

By providing your phone number and creating an account, you expressly consent to receive SMS text messages and voice calls from TappaTag related to the Service.

Program description. TappaTag uses SMS to deliver finder-call alerts and optional pet care reminders. Voice is used to connect finders to pet owners through TappaTag's private relay. Voice is never used for marketing.

  • Message frequency: Varies. Call alerts depend on finder activity. Care reminders follow the schedule you select (e.g., every 30 days, 90 days, or annually).
  • Message and data rates: Standard message, data, and calling rates from your wireless carrier may apply.
  • Opt out: Reply STOP to any TappaTag SMS message to opt out of all SMS messages from TappaTag.
  • Help: Reply HELP to any TappaTag SMS message for support, or contact us at hello@tappatag.com.
  • Consent not a condition: Consent to receive SMS messages is not a condition of any purchase. You may manage individual reminder types from your dashboard.
  • Carrier liability: Wireless carriers are not liable for delayed or undelivered messages.

All SMS and voice communications are subject to the Usage Limits & Abuse Prevention section above.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Impersonate another person or submit false or misleading pet, contact, or veterinarian information;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service or any TappaTag tag;
  • Scrape, crawl, or use automated means to access the Service except as expressly permitted;
  • Resell, sublicense, or commercially redistribute access to the Service or finder pages;
  • Interfere with or disrupt the Service, servers, or networks connected to the Service, including by overwhelming the call relay or SMS systems;
  • Use the Service to harass, threaten, surveil, or send unsolicited communications to any person; or
  • Infringe the intellectual property, privacy, or other rights of any third party.

Your Content & License to TappaTag

You retain ownership of all content you upload to the Service, including pet photos, pet names, profile descriptions, and veterinarian information (“Your Content”).

By uploading Your Content, you grant TappaTag a worldwide, non-exclusive, royalty-free license to host, store, display, transmit, and reproduce Your Content solely for the purpose of operating and providing the Service — including displaying Your Content on the finder page when your pet's tag is scanned. This license ends when you delete the content from your account or close your account, except to the extent that backups, logs, or cached copies persist for a reasonable period during routine system operation.

You represent and warrant that you own or have the necessary rights to Your Content and that Your Content does not infringe any third party's rights.

Intellectual Property

The TappaTag name, logo, website, software, tag designs, and all related materials are the property of TappaTag and its licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or create derivative works from these materials without our prior written permission. All rights not expressly granted to you in these Terms are reserved.

Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, send a written notice to hello@tappatag.com with: (i) identification of the copyrighted work, (ii) identification of the allegedly infringing material and its location, (iii) your contact information, (iv) a statement that you have a good-faith belief the use is not authorized, (v) a statement under penalty of perjury that the information is accurate and you are authorized to act, and (vi) your physical or electronic signature.

Disclaimer of Warranties

Except for the express One-Year Tag Warranty above, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

TappaTag is a communication tool, not a tracking, recovery, or location service. We make no promises about whether or how quickly a lost pet will be returned. We do not guarantee response times, finder availability, message delivery, call connection, or any particular outcome from a tag scan.

Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our warranty obligations are limited to the maximum extent permitted by applicable law.

Limitation of Liability

To the fullest extent permitted by law, TappaTag and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of a pet, emotional distress, veterinary costs, or lost profits, arising from your use of or inability to use the Service.

Our total aggregate liability to you under any claim, regardless of the form of action, shall not exceed the original purchase price of the tag giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under applicable law.

Some jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless TappaTag and its owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your violation of these Terms, your misuse of the Service, your submission of inaccurate pet, contact, or veterinarian information, or Your Content.

Force Majeure

TappaTag is not liable for any failure or delay in performance caused by events outside its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, governmental action, labor disputes, internet or telecommunications outages, third-party service provider failures, or power failures.

Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that harms TappaTag, other users, or third parties. You may close your account at any time by contacting hello@tappatag.com.

On account closure or termination:

  • Pet profile data is deleted within a reasonable period, subject to backups and any legal retention obligations.
  • Active tags are deactivated and will no longer route to a profile when scanned.
  • Refunds are issued only as expressly provided in the Refund Policy above.

Changes to Terms

We may update these Terms from time to time. For material changes, we will provide notice by email to the address associated with your account at least 30 days before the change takes effect. Continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms. Material changes to the One-Year Tag Warranty or Refund Policy will not apply retroactively to tags purchased before the change.

Export Controls & Sanctions

You represent that you are not located in, and are not a national or resident of, any country subject to U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Indiana, and you consent to the exclusive jurisdiction of those courts.

Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, or to any affiliate.

Severability & Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TappaTag regarding the Service and supersede any prior or contemporaneous understandings, communications, or marketing materials.
